What Is Public Law 28-57?

Public Law 28-57, otherwise known as the Transparency Act of 2005, was signed into law by Governor Felix P. Camacho on June 30, 2005. It mandates that all Government of Guam agencies and departments, inclusive of all autonomous agencies as well as the Legislature and Judiciary, develop and post a Web site within 120 days of the enactment of the law -- by October 28, 2005. The law also requires each agency to post on its Web site several pieces of "required information." The full text of Public Law 28-57 is available at the Web site of I Liheslaturan Guåhan.

The Guam EPA Web site has been online since January 2, 2001. It was then and remains today one of the most comprehensive Web sites of any Government of Guam entity. The specific information required to be posted on the Guam EPA Web site per Section 3 of Public Law 28-57 is listed here in the order noted in the law.

  1. Notice of all meetings, hearings, and public events as required by public law and for such duration as required by public law and containing such information as is required by public law.
    Meeting notices are regularly posted on the Web site's main page (guamepa.govguam.net); public notices are posted and indexed on the Public Notices and News Releases page at guamepa.govguam.net/programs/admin/notice.html.
  2. The official name of the department, agency, autonomous agency or public corporation in both English and Chamorro, the e-mail address, public phone numbers, mailing address and physical location of the department, agency, autonomous agency or public corporation.
    This information is included on the Web site's main page (guamepa.govguam.net); additionally, a map to our facilities is included on the Directions page at guamepa.govguam.net/about/directions.html; a complete listing of staff e-mail addresses is available on the Staff Listing page at guamepa.govguam.net/about/staff.html.
  3. The names and titles of the Director, Deputy Director, or official in charge of the department, agency, autonomous agency or public corporation, as appropriate, as well as the names and titles of the administrators of each and all offices, programs, services, units or divisions under its purview, and the names of all board members of every board or commission associated with or appurtenant thereto, and an organizational chart demonstrating the relationships between all, as relevant.

  4. A list of all fees charged for any services.
    A chart listing fees and services will be available on this page in the very near future.
  5. All rules and regulations in force as promulgated by the department, agency, autonomous agency or public corporation, or links thereto, as well as all proposed rules and regulations, or amendments thereto, as are progressing through the administrative adjudication process as detailed in the Administrative Adjudication Act.

  6. The budget for the department, agency, autonomous agency or public corporation as is in force and approved by I Liheslaturan Guåhan or the governing board as appropriate, as well as the proposed budget for the upcoming fiscal year, and in such form as is submitted to or approved by I Liheslaturan Guåhan or the governing board as appropriate, and all expenditures of the department, agency, autonomous agency or public corporation, such entries to be updated on a quarterly basis.

Expenditures for FY2005 under the Consolidated Grant totaled $3,452,283.61; expenditures under the DSMOA grant totaled $65,232.43; and expenditures from special funds totaled $783,678.40 (total combined expenditures of $4,301,194.44 for FY2005).
  7. The awardee, amount, duration and a general description of all contracts of any nature as entered into by the department, agency, autonomous agency or public corporation, such entries to be updated on a quarterly basis.

  8. The amount of and a general description of all grants received by the department, agency, autonomous agency or public corporation.

    The Agency receives a "Consolidated Grant" from U.S. EPA to run most of the Agency's federally-funded programs. As authorized by the Omnibus Territories Act of 1977, the consolidated grant process allows U.S. EPA to consolidate funding from different programs into one grant award. The Agency then has the ability to allocate funds among its federally-funded activities as it sees fit, provided that the work plan objectives of the federal grant are met.

    The Agency also receives a separate grant from the Department of Defense to fund the Defense and State/Territorial Memorandum of Agreement (DSMOA) program.

  9. The hours of operation of the department, agency, autonomous agency or public corporation, and all programs, units or services under its purview.

  10. A general description of the areas of responsibility of the department, agency, autonomous agency or public corporation, and all offices, programs, services, units or divisions under its purview, as well as any public reports, studies and publications as the public might expect access to under Guam law, or links thereto, and forms, notices or circulars required to be used by the public while interacting with the department, agency, autonomous agency or public corporation, and all offices, programs, services, units or divisions under its purview.
    The general description of Agency programs is available on individual program pages, all of which are linked from guamepa.govguam.net/programs/index.html; all permit application forms and instructions are available on this site and are indexed at guamepa.govguam.net/permits/index.html; reports, studies, and publications are included under the various program pages.
  11. The results of audits, or links thereto, of the department, agency, autonomous agency or public corporation, or any component or service of same.
    The Agency does not currently have any audit results available. Any results that may be available in the future should be available at the Web site of the Office of the Public Auditor.
  12. In the case of a department, agency, autonomous agency or public corporation that generates its own income through fees for services or other fees, an annual statement detailing collection and income derived from such fees.
    An annual statement from the Department of Administration detailing Guam EPA's fee collections will be available on this site in the very near future.
